O R D E R
This chamber summons is taken out by the plaintiff for making
amendment in the plaint as well as in the notice of motion. This
chamber summons resisted on behalf of the defendant Municipal
Corporation by filing their reply. Read the present chamber summons,
affidavit of the plaintiff in support of chamber summons and reply of
the defendant. Heard both the learned counsels on behalf of both the
sides at length. Perused the record.
2. On scrutiny of the pleadings and proposed amendment which is
specifically given schedule by the plaintiff under this chamber summons
and on careful scrutiny of the proposed amendment, I think if the
proposed amendment is to be allowed, certainly the nature of the suit
will not be changed. Moreover, the said proposed amendment are with

the knowledge of the defendant Municipal Corporation. Therefore, the
proposed amendment will not cause any injustice on the part of the
defendants, it will help to decide real controversy between the parties.
Therefore, I inclined to allow this chamber summons. Hence, I have
proceed to pass following order.
ORDER
1. Chamber summons no.1083/18 is hereby allowed as prayed for.
2. The plaintiff and his advocate are hereby directed to carry out
proposed amendment within stipulated period.
3. Chamber summons no.1083/18 is disposed off accordingly.
