ORAL ORDER
This is the notice of motion taken by the plaintiff to set aside the
no say order dated 26.07.2024 passed against them in Notice of Motion
no. 122/2024 taken by defendant under order 7 rule 11 of CP.C.
2. The plaintiff averred that the Notice of Motion taken by the
defendant was pending for the say. However, this Court has passed no
say order against the plaintiff on 26.07.2024.

3. the defendant has taken strong objection to this application on
the ground that the plaintiff is unnecessarily causing delay by filing this
false and frivolous Notice of Motion. Hence prayed to reject the same.
4. Heard both the sides at length. The learned counsel for the
plaintiff argued that there is no intention or malafide reason on his part.
Hence for the ends of justice prayed to allow the Notice of Motion.
5. I have gone through the application and say. For the ends of
justice and to decide the real controversy between the parties the Notice
of Motion taken by the plaintiff is deserves to allow. Hence, following
order.
ORDER
1. Notice of Motion is allowed.
2. The no say order dated 26.07.2024 is hereby set aside.
3. Notice of Motion disposed off accordingly.
4. The plaintiff is directed to register the Notice of Motion for
statistical purpose.
5. Accordingly the say filed by the plaintiff to the Notice of Motion
no. 122 of 2024 is read and recorded.
