Arguments on the chamber summons have already been heard. By the chamber summons the applicant Vedprakash claims to be the owner of attached flat. The plaintiff claims that the defendants are the owners of the attached flat. It is material to know that there are no documents produced on behalf of the plaintiff to show that the defendants are the owners of the attached flat. At the same time, the applicant vedprakash though produced society bill, electricity bill, gas connection bill details, the same stand in the name of Kusumlata chaube. Further, share certificate is not produced on record. In these circumstances, it will be just and proper to issue notice to the Oshiwara Shantivan -B CHS LTD to produce the share certificate and also all the documents of title in its possession regarding the flat No.233 building No.2, Oshiwara, MHADA, Andheri West Mumbai. Hence, issue notice accordingly to the concerned society. The plaintiff to take steps to serve the notice on the said society.
