Oral Order:
The applicants by this chamber summons want to interpose
themselves as legal heirs and representatives of the deceased
original plaintiff Madhukar Waman Dixit. Heard. Perused.
2. According to the plaintiffs the original plaintiff Madhukar
Waman Dixit has expired on 20th February 2018. Except
applicants Prasad Madhukar Dixit and Prajkta Madhukar Dixit
there are no other legal heirs/representatives of the deceased
plaintiff. Learned Counsel for the defendant 1(a) and (b) has
no objection.
3. The suit is for partition. The legal heirs/representatives of

the deceased plaintiff are ready to continue with the suit claim.
They can be interposed as plaintiffs as legal
heirs/representatives of the deceased plaintiff.
In the result, following order is passed:
ORDER
1. Chamber Summons no. 808 of 2016 is allowed in terms of
prayer clause (a).
2. The applicant nos. 1 (a) and 1(b) be interpose as Legal Heirs
and Representatives of deceased plaintiff Madhukar
Waman Dixit in the suit.
3. The applicants to carry out consequential amendments and
serve amended copies on the defendants within two weeks
from today.
4. No costs.
