Defendant nos.1 to 6 are present before the court.
Defendant no.9 present for himself and Defendant no.7,8
and 10. Document of copy of power of attorney executed
by Defendant nos.7,8 and 10 in favour of Defendant no.9 is
filed on record. I have perused said copy of power of
attorney and it is noticed that by said power of attorney,
Defendant nos.7,8 and 10 have empowered Defendant no.9
to compound the suit and other proceedings. Plaintiff nos.1
to 3 and above referred Defendants have admitted the
contents of consent terms Exh.3 by submitting that they
have gone through the consent terms and they admit the
same to be true and correct. Plaintiff nos.1 to 3 and
Defendant nos.1 to 6 along with Defendant no.9 for himself
and Defendant nos.7,8 and 10 are directed to sign consent
terms in presence of the court and they have signed it
before the Court. As such, consent terms are verified. Three
Demand drafts referred in para no.2 of Consent terms are
handed over by Defendants in presence of the Court to
Plaintiff no.1 to 3. ORDER BELOW EXH.1 1. As Plaintiffs
and Defendants have arrived at compromise and filed
consent terms Exh.3, suit stands decreed in terms of
consent terms. 2. As the suit is filed for partition and
declaration and as it is settled by way of consent terms
parties are directed to register the decree by annexing copy
of consent terms to it and they are directed to deposit
necessary stamps duty as required by law. 3. Decree be
drawn up accordingly.
