Plaintiff not disputing that the Defendant no.1 given inspection as well as photocopy of document at serial no.a to e mentioned in the para no.8 of the affidavit whereas the document at serial no.f is not provided. The Defendant in its reply contended that those allotment letters are not traceable at present. In my view, the Plaintiff can take appropriate steps for proving those documents by leading secondary evidence. The other documents are supplied with hence, Notice of Motion can be disposed off. Thus, the Notice of Motion no.2034/19 is disposed off as complied with. Case is adjourned to 13/12/2019 for filing of evidence on affidavit.
