Advocate for defendants filed say that she has no instructions and
matter from defendants. The plaintiff is praying for striking the written
statement of defendants as he has not complied with orders in Notice of
Motion No.3687/2022. The roznama reflects that the order passed in
Notice of Motion No.3687/2022 is not complied till date as per orders
defendants were directed to deposit Rs.75,000/- per month as a
compensation with respect to suit premises to the plaintiff. Roznama
reflects that defendants have not complied this order dated 01.02.2024
passed in Notice of Motion No.3687/2022 and has committed default.
Thus in terms of the provision of Order 39 Rule 11 the defense of
defendants is liable to be strike out. Hence, defense of defendants 1 to 3
is strike out. Parties to take note.
