This Notice of Motion is taken out by defendant no. 1 for
recalling order of no cross passed by this court on 21.03.2018 and
permitting him to cross examine the plaintiff's witness.
2. Defendant submitted that on 21.03.2018 the counsel of the
defendant was held up before the Hon'ble High Court. Hence, no cross
order was passed.
3. Considering the rival submission in the interest of justice one

last opportunity is granted to the defendant to crossexamine the
plaintiff on next date by imposing costs. Accordingly, I pass the
following order.
: ORDER :
1. Notice of Motion No.1691 of 2018 is made absolute in terms
of prayer clause (a) subject to cost of Rs. 3000/.
2. Cost be paid on or before next date.
3. Defendant is directed to crossexamine the plaintiff on
03.09.2018.
