On perusal of order dated 20/08/2018 passed by my learned predecessor it is noticed that my learned Predecessor has observed that this suit is filed for challenging the notice dated 29/12/2008 issued u/s 351 of BMC Act.  L. C. Suit no.90/2009 is also on the board of this Court today.  On perusal of plaint of suit no.90/2009 it is noticed that notice u/s 351 of BMC Act dated 29/12/2008 is challenged in said suit.  Notice dated 29/12/2008 is admittedly the notice issued u/s 354 A of BMC Act and in present suit the notice u/s 351 of BMC Act is challenged but as observed by my learned Predecessor the notice of 29/12/2008 is again challenged in this suit.  As notice u/s 351 of BMC Act is issued after issuance of notice u/s 354 A of BMC Act  it becomes clear that Defendant/BMC now can not take any action on the basis of notice u/s 354 A of BMC Act.  In such circumstances, claim of L. C. Suit no.90/2009, whether survives or whether it become infructuous is the question and to find its answer, Plaintiff herself will have to think over and Plaintiff will have to take further steps in my opinion for withdrawal of suit no.90/2009.
At this stage advocate for Plaintiff submitted that, today Defendant\''s advocate has filed certain documents with list of documents Exh.3 he will study those documents and will argue NM on next date.  Considering submissions adjourned.
