CHAMBER SUMMONS NO.664 OF 2020. Plaintiff
has filed present C/S No.664/2020 seeking
substitute service of writ of summons. It is
submitted that plaintiff tried to serve to defendant
summons on three occasion. However it returned
unserved for one or the other reason. Plaintiff
seeks service of writ of summons by way of
pasting. On perusal of three service affidavit filed
on record, it appears that the summons send by
post are returned are unserved for the reason of
company locked. Thus, it appears that defendant
can not be served through regular mode. However
the considering the reason of non service, it would
be just and proper to allow service by way
substitute service, not simply by pasting summons,
but by way of paper publication. Hence, the order.
ORDER 1) Chamber Summons No. 664 of 2020 is
allowed and thereby plaintiff permitted to serve
the defendant by way of advertisement in news
paper as per sub rule1(A) of Rule 20 of Order V
of CPC. Matter is adj to 30/01/2023 for
compliance.
