Today, matter is posted for hearing on Summons for Judgment. Matter was taken up for the hearing. During the course of hearing, it is found that only defendant No.2 had applied for leave to defend, though both the defendants had caused appearance through advocate Mr. Ganesh Patil by filing Vakalatnama. However, when lateron it is revealed to defendant No.2 that Vakalatnama was not filed within 10 days after serving the Writ of Summons, defendant No.2 took out the Notice of Motion for condonation of delay in entering the appearance  and that motion was allowed and defendant No.2 then filed reply to Summons for Judgment for leave to defend the suit. Thus, only defendant No.2 had made valid and legal appearance for the purpose of the suit and not by defendant No.1, as Vakalatnama filed was not within the period of 10 days. On this background, ex-parte order against defendant No.1 was to be passed, but  inadvertently it remained to pass. Hence, I proceed to pass the order.

Though the suit summons is duly served on defendant No.1, he failed to appear and therefore, the suit to proceed ex-parte against him.

On perusal of the record, it is found that advocate Ganesh Patil had filed the Vakalatnama as if he was representing to both the defendants.  However, he is claiming that his Vakalatnama is only for defendant No.2. On close scrutiny of the Vakalatnama, it is revealed that Vakalatnama is signed by defendant No.2 only, but in the body of the Vakalatnama instead of mentioning defendant No.2, the said advocate used the word defendants and created confusion. However, it is now confirmed that advocate Ganesh Patil is appearing only for defendant No. 2 and defendant No.1 did not appear at all despite the service of writ of summons. Therefore, for having the clarity in the proceeding, the formal order of     ex-parte against defendant No.1 is being passed.

Perused application and record. Heard ld. counsel for plaintiff. It is submitted that plaintiff has wrongly mention in para 4 of evidence original purchase order is placed on record. However, plaintiff has filed print out of email purchase order and plaintiff wants to adduce additional evidence in that respect. Thus, considering the facts and circumstances, I am of view that if application is allowed, no prejudice would cause. Hence, I proceed to pass following order.

 2. Additional evidence of plaintiff be taken on record and marked    as Exh.4 A.
