Today, plaintiff and defendant No. 1 are present and their advocate
are also present.
Plaintiff and defendant No. 1 filed consent terms. TOR. It is marked
at Exh. 05 and submitted that they have amicably settled their
dispute in view of consent terms. Both the parties admitted the
contents of consent terms. It is also submitted in consent terms that
plaintiff don’t seek any relief against defendant No. 2/BMC and
defendant No.3/MHADA. Therefore, advocate for defendant Nos. 2
and 3 have no objection for the consent terms. It is also submitted
that today, keys of first floor premises are handed over by
defendant No. 1 to the plaintiff and possession of first floor as well
as ground floor is given to the plaintiff and defendant No. 1 has
also handed over to the plaintiff one cheque and three post dated
cheques of Rs. 3,00,000/- each. Thus, it transpires that matter has
been amicably settled between the parties in view of consent terms.
Hence, I proceed to pass following Order:
ORDER
1. The suit is hereby disposed of as compromised in view of
consent terms at exhibit 05.
2. Pending NM Nos. 3869/2017. 1510/2017 and 1653/2018 also
stands disposed off.
3. Decree be drawn-up accordingly. Consent terms (Exhibit 05) be
treated as part and parcel of decree.
4. Court fee be refunded as per rule.
5. The suit stands disposed of accordingly.
