Tripati along with plaintiff present and submitted that they
want to withdraw suit. Defendants have opposed the
application and submitted that cost be imposed. Heard, both
advocates. Application for withdrawal is allowed subject to
payment of cost of suit to defendants. Plaintiff is permitted to
withdraw the suit. Court fees be refunded to plaintiff as per
rules. Notice of Motion No.1958/2019 is disposed of as
withdrawn and for want of prosecution. Parties to take note.
Accordingly order is passed below Exhibit-1. ORDER
PASSED BELOW EXHIBIT-1. In view of order passed on
application at Exhibit-11, the plaintiff is permitted to withdraw
the suit No.1301/2019 subject to payment of costs of the suit to
defendants. Court fees be refunded to the plaintiff as per rules.
Proceeding of Suit No.1301/2019 and Notice of Motion
No.1958/2019 are closed.
