It is contended by the defendant that it was unable to file its written statement in time due to heavy work load being a public body. Therefore , delay was caused for filing written statement. 5. Considering the submissions made by the advocates of the plaintiff and the defendant, this Court holds that the defendant was unable to file written statement due to heavy work load. The reason given by the defendant for delay is satisfactory. The delay caused for filing is not deliberate. 6. In these backgrounds, the Notice of Motion deserves to be allowed in the interest of justice and in consequence allowing the defendant to file written statement. Hence, order. ORDER 1.
