is passed on Chamber Summons No. 1034/2019. Order
Plaintiff has taken out present chs. For allowing him to
name of defendant no. 09 and to allow him to carry out
necessary amendment as per schedule in the plaint. Perused
the affidavit in support of chs. and record. Heard ld. Adv.
for plaintiff and ld. Adv. for deff. no. 03. From the affidavit
in support of chs., it appears that, defendant no. 09 is
expired on 21/11/2016 and defendant no. 10 is the sole
heir/legal representative of deff. no. 09 and she is already
on record. The proposed amendment is of formal nature and
no prejudice is likely to be cause to the defendants, if chs. is
made absolute. Moreover, proposed amendment also
appears necessary for determining the question in
controversy between the parties. Therefore, Chs. deserves
to be made absolute, Hence court proceeds to pass th
following order. ORDER 1) Chamber Summons No.
1034/2019 is made absolute. 2) Plaintiff shall carry out
necessary amendment as per schedule within 14 days from
the date of this order. 2) Chamber Summons No. 1034/2019
is disposed off accordingly. Authenticated copy of Roznama
be given to both the parties if requested. Matter adjourned
for compliance and issues to 08/06/22.
