Adv. for the plaintiff filed withdrawal application. Taken on

present application is moved by the plaintiffs No.1 and 2
through their holding advocate praying for permitting them
both to withdraw the suit as they do not want to proceed with
the matter and also prayed for refund of the court fees as per
rule. Heard the Ld. counsel for the plaintiffs and as well as
plaintiffs No.1 and 2 in persons. The matter is for ex-parte
evidence of the plaintiff. The plaintiffs No.1 an 2 present both
submitted that they do not want to proceed with the suit, the
dispute being settled and therefore, the may be permitted to
withdraw the suit accordingly. Since the plaintiffs present and
submitting that they both do not want to proceed with the
matter are intending to withdrawing the same unconditionally,
both the plaintiffs admitted filing of this application as well as
their respective signatures on the application and also admitted
the contents of the application. Hence, the plaintiffs are
permitted to withdraw the suit. See further order below Exh.01.
Order below Exh.01. 1. In view of order below Exh.13, the
plaintiffs are permitted to withdraw the suit as such the suit is
disposed of for want of prosecution. 2. No order as to costs. 3.
The court fees be refunded to plaintiffs as per rule. 4.
