ORDER
Plaintiff has taken out this chamber summons for
amendment in title cause.
2. It is argued on behalf of plaintiff/bank that as per the
amalgamation scheme of financial institutes Dena Bank is merged into
Bank of Baroda. Said merger is duly approved by government of India.
Therefore, plaintiff be allowed to amend the plaint by replacing name of
Dena Bank as Bank of Baroda.
3. Defendant has resisted the application on the ground that
no documentary evidence is produced to that effect. So also application
is filed at belated stage.

4. Plaintiff is seeking amendment by virtue of merger of
financial institutions. There is copy of gazette of India showing that
Dena Bank is merged in Bank of Baroda and it is approved by
government of India. Neither it will change the nature of suit nor will
cause any prejudice to defendant. Therefore, there is no any implement
impediment in allowing the amendment. Accordingly the order.
ORDER
1. CS No.1007/19 in SU No.2632/18 is hereby allowed.
2. Plaintiff/Bank is permitted to carry out the amendment in
plaint by replacing name of Dena Bank by Bank of Baroda.
3. Plaintiff to carry out necessary amendment within
stipulated time.
