The plaintiff filed application for unconditional withdrawal of the suit and Notice of Motion. On
behalf of the company its authorized signatory Mr. Alok Jain present who has also affirmed the
plaint. He has filed the copy of the resolution dated 23.5.2019 wherein he is authorized to withdraw
the suit. The defendant nos. 2 and 3 have given no objection. I verified the authorized signatory of
the plaintiff company and he affirmed the contents in the withdrawal application. Even the Ld.
counsel for the plaintiff made a statement at bar that he had word with the Directors of the
Company and they have informed him for withdrawal of the suit. Hence, it is expedient to pass
following order.
ORDER
1. Suit is disposed of as withdrawn.
2. No order as to costs.
3. Draft Notice of Motion is also disposed of.
4. Draft Notice of Motion be registered for statistical purpose.
