BHOSALE (COURT ROOM NO. 32) DATE : 27th August, 2019 CHAMBER SUMMONS ORDER Heard Ld.Counsel for plaintiff. Perused affidavit filed by plaintiff in support of Chamber Summons. It is submitted by the plaintiff as earlier writ of summons is issued against defendant. However, the same is returned back with endorsement "unclaimed". It is further submitted that plaintiff wants to send summons to the defendant on his second address. She filed bank pass book of defendant in support of contention made in the application. And finally it is prayed that permission may be granted to the plaintiff to amend new address of defendant no.1 in the main cause of suit. I have perused entire record it appears that in view of service -- 1 of 3 -- 2 affidavit below Exh2 summons is duly executed to the defendant and the acknowledgment the signature of defendant is on record below Exh.No.2B. Further more the service affidavit of Chamber Summons is also executed to the defendant on his address mentioned in the main title of the suit. When the summons is properly executed and defendant does not disputed address over it then the summons properly served to the defendant and therefore there is no need to grant permission for amendment to incorporate second new address of defendant on main cause of title. Thus, I do not find any merit in the application. Hence, I proceed to pass following order. ORDER Chamber Summons No.999 of 2019 is dismissed and disposed of in above terms.
