F.R.S.R. Following order is passed-
ORDER
1.Defendant corporation is hereby directed to consider reply and documents submitted by plaintiff and then to pass speaking order as expected by law within 15 days from the date of this order.
2.In the meantime defendant shall not demolish the notice structure.
3.In the meantime plaintiff shall also not add or develop the notice structure in any manner.
4.After passing speaking order defendant shall give 7 days time to plaintiff to challenge it before the competent court/forum if required.
5.Plaintiff shall avoid delay in any manner on his part.
6.Admittedly suit is filed before passing speaking order and the same is premature. Plaintiff will get an opportunity to file fresh suit and fresh N/M on the basis of new cause of action subject to proposed speaking order of MMC. Hence, the suit No. 1285/2020 and N/M No.1781/2020 are hereby disposed of.
7.Parties shall place on record original and dated photographs of notice structure in due course of time.
8.Authenticated copy of roznama be given to parties if requested.
