The Plff filed application for leave to produce additional documents to which the Ld advocate for Deft strongly resisted contending that at this stage if the plff propose to file any such additional documents the should first go for amendment in plaint, plead about the documents and then only the documents can be taken. In absence of affidavit the documents can not be taken on record.
The Ld Adv for plff submitted that, pleading in respect of the documents is already their in the plaint.
The plaint states about maintenance bill, maintenance charges due against the deft. As such the documents are relevant. Now the effect and impact of these documents, whether for the reason of production of these documents the deft is entitled to unconditionally leave/ condition leave to defend are all the question which can be argued by the parties particularity the deft in course of his argument. At this stage leave is granted to produce the documents keeping open rights of the deft to raise his contention regarding the documents.
