ORAL ORDER
Perused the chamber summons. This chamber summons
is taken out by the plaintiff for bringing the legal representatives of
defendant no.10 on record.
2. Perused the chamber summons which is supported by an
affidavit being executed by the director of plaintiff Mrs. Bharati J.

Thakkar. The copy is duly served upon the proposed LR's. Heard
learned advocate Shri Gandhy and Adv. Tavadia. Along with the
chamber summons copy of death certificate is issued by the Municipal
Corporation of Greater Mumbai which shows that the defendant
no.10 Geeta Pratap Thakkar has expired on 15th January, 2020. This
chamber summons is taken out on 16th March, 2020. This chamber
summons is very well within the limitation. Right to sue survives and
considering the same, it is necessary to bring legal representatives of
defendant no.10 on record. Hence, I pass the following order.
ORDER
1. Chamber summons no. 243/21 is allowed and made
absolute in terms of prayer clause (a) and (b).
2. The plaintiff to carry out the amendment within two
weeks and shall supply the copy of amended plaint to the
defendants two weeks thereafter. So also the plaintiff is
directed to place on record the separate amended plaint for the
purpose of record.
3. Chamber summons is disposed off accordingly.
