ORDER
This is a Chamber Summons is taken out by the defendant for for
extension of time to deposit amount as per order of the court passed in
Summons for Judgment No.271 of 2017 dated 27.02.2019. The
plaintiff has filed reply to the same.
2. Perused the Chamber Summons and reply of the plaintiff. Heard
both the advocates for the parties at the length.
3. It appears from the record that defendant was granted conditin
leave to defend on depositing amount of Rs.17,76,840/- within four
weeks from the date of order 27.02.2019. This Chamber Summons is
taken out of the defendant for extension of time for depositing the said
amount on 25.04.2019 i.e. after more than four weeks period from the

date of order in Summons for Judgment 722 of 2017. From the of the
order till the date of taking out Chamber Summons defendant is not
deposited the said amount. The defendant has also not sought extension
of time to deposit and comply to said order in Summons of Judgment
before expiry of period of four weeks from the date of the order dated
27.02.2019. There is no provision for extending of time for compliance
of order of depositing the amount after expiry of period stipulated in
the order. Therefore, time can not be extended to comply the order in
Summons for Judgment No.274 of 2017.
4. In these background, the Chamber Summons being devoid of any
merit is liable to be dismissed. Hence, the order. :
ORDER
1. The Chamber Summons No.959 of 2019 is dismissed.
3. The Chamber Summons No. 959 of 2019 is disposed off.
