Thorat tendered copy of the judgment and order dated 23.04.2018 passed in appeal from order No. 220 of 2018 by the Hon\''ble High Court (Coram - Smt. Anuja Prabhudessai, J.) Whereby the statement made by Senior Adv. Mr. V. A. Thorat on behalf of the Appelant-plaintiff herein to the effect that the appellant seeks leave to withdraw the said appeal with liberty to file writ petition and further upon filing the writ petition within 4 weeks, the appellant would withdraw the suit pending before this court, was recorded and accepted.
Ld. Adv. Thorat submits that in furtherance of the said statement the plaintiff who is present in the court seeks leave to withdraw the suit unconditionally. Considering the aforesaid statements and endorsement made by the plaintiff and the Ld Adv. Thorat below the verification clause of the plaint, the suit is dismissed as withdrawn unconditionally. No orders as to costs. Court fee be refunded to the plaintiff as per rules. The formality of registration of the suit be completed within a period of week from today. The draft NM is also disposed off with a direction to register the same for statistical purpose.
