Plaintiff alongwith Shri. Mr. Manish Yerunkar and Shri. Mr.
Deepak Chavan POA on behalf of the defendant.
Ld. counsels for the parties have filed consent terms before the
court stating settlement and compromise between the parties.
Consent Terms
The consent terms and the contents of terms of settlement are
verified in the presence of both the parties and the counsels.
Consent terms are Read and record and
FRSR following order is passed.
1. In view of the compromise and settlement between
the plaintiff and the defendant, the suit is disposed of. A consent
decree in terms of settlement vide Exh.3 shall be drawn up
accordingly.
Copy of the consent terms shall form part of decree.
2. Office is directed to prepare a decree in terms of
settlement expeditiously so that the parties can act upon the same
and take further steps for registration of the fresh agreement of
sale dated 9.12.2020.
3. Pending Notice of Motion NO.1887/2020 is also
disposed of along with the suit as the same has become
infructuous.
4. In the circumstances of the case, the plaintiff shall
bear his own costs and the plaintiff shall be entitled to refund of
court fees, if any, as per rules.
Suit stands disposed of accordingly. However, Suit
shall be registered for statistical purpose.
