The plaintiff no.1 has filed present application and prayed that matter be removed from dismissal caption and he under takes to comply with the order Dtd.11.07.2024 within 7 days.
The defendant no.1 to 4 have vehemently objected the application on the ground that order were passed in CS on Dtd.16.07.2023 and 11.07.2024. But till date plaintiff has not complied with the above order and application Dtd.14.10.2024 seeking time was rejected. On 24.12.2024 further request for extension of time was rejected. Hence, prayed application be rejected.
The Ld. Advocate for plaintiff has submitted that in the interest of Justice application be allowed. On contrary Ld. Advocate for defendants had submitted that necessary order be passed after perusing roznama.
It would be worthwhile to mentioned that in pursuant to order passed in CS No. 1481/2023 and 1480/2023 the plaintiff was granted permission to bring on record LRs. of deceased plaintiff no.10 and also delete the name of defendant no.5 and add names of proposed defendants. But on perusal of roznama it appear that inspite of ample and sufficient opportunities and plaintiff failed to comply with the above order. The plaintiff had filed application on 14.10.2024 for compliance which was rejected. Thereafter plaintiff had filed another application 24.12.2024 which was also rejected. Therefore it is clear that plaintiff was not at all diligent in complying the above order in spite of granting ample and liberal opportunities. In such a contingency I am not willing to grant time for complying with the above order.
Hence, application vide Exh.14 is rejected.
