ORDER BELOW DRAFT NOTICE OF MOTION
The draft N/M is supported by an affidavit of Smt. Anjali Chavan.
Heard Ld. Adv. Mr Kulkarni for the plaintiff on the urgent draft N/M seeking interim protection as per prayer clause (a) of the draft N/M. Ld. Counsel for the plaintiff submitted that, the plaintiff applicant is in possession of the suit premises and this Court was pleased to grant interim protection to the plaintiff vide order dated 20.5.2019.  The plaintiff is in possession of the suit premises since the year 1996 by way of transit accommodation and has sought permanent alternate accommodation  after reconstruction of the building vide application dated 8.1.2020. Ld. Counsel further submitted that, now the defendants have issued notice dated 19.6.2020 regarding demolition of the building vide Exh.6 filed with the Motion. On 18.7.2020, Rent Collector Sudhakar Shahane of the defendants threatened dispossession of the plaintiff from the suit premises. Hence, urgency in this matter.  He made statement that the defendants have been served with the draft N/M and he will file necessary affidavit within one week. Considering the prima facie material and documents on record and submission made before the court as well as interim protection granted by this court to the plaintiff vide order dated 20.5.2019, the plaintiff is granted interim protection in terms of  prayer clause (a) of the draft N/M  till next date.  The plaintiff to comply with the provisions of Order 39 Rule 3 of CPC. Issue notice to the defendants no.1 and 2 to show cause as to why the adinterim relief granted should not be confirmed, returnable on 10.8.2020.authenticated copy of today\''s Roznama be given to the Ld. Counsels for both sides for information and compliance.
