O R D E R Defendant has taken out this Chamber Summons for condonation of delay in entering and appearance. 2. The present suit is being filed under Order XXXVII of the Code of Civil Procedure. According to Rule 3 (1) of Order XXXVII the defendant is required to enter an appearance within 10 days from the date of Service of Summons. 3. Defendant caused delay of 15 days in entering in appearance. Plaintiff has formal objection to grant this Chamber Summons in order to expedite the matter. It is contended by defendant that, the Officers of Accounts Department were busy in the year ending work, therefore, could not approached Government Pleader Office and -- 1 of 3 -- :2: Ch. Sum. No. 744/2018 in Summary Suit No. 1043 of 2017 caused delay. Rule 7 of Order XXXVII provides that, if sufficient cause shown by the defendant the Court may excuse the delay of the defendant in entering an appearance. Since, plaintiff has formal objection to grant this Chamber Summons and the cause shown by the defendant for delay in entering an appearance appears to be genuine, this Chamber Summons is deserves to be allowed.
