ORDER
This is the Chamber Summons moved by the defendant seeking
condonation of delay of 127 days in filing affidavit in reply to the
Summons for Judgment. Perused the Chamber Summons and
supporting affidavit. The present Chamber Summons is opposed by the
plaintiff by filing reply affidavit.
Heard both sides at length. Perusal of accompanying documents
by both parties alongwith Chamber Summons and supporting affidavit
so also, with the reply affidavit, it appears that, no doubt, there are
latches on the part of the defendant to be diligent and to file reply
Summons for Judgment in time, at the same time the accompanying
documents discloses that, the plaintiff bank is also lethargic and not

diligent serving the Summons for judgment in time. Whatever may be
the reasons, to decide the matter on merits and to give one chance to
the defendant, this Chamber Summons needs to be allowed.
Considering the reasons in the Chamber Summons and the
circumstances brought on record, there shall be no order as to costs.
Hence, following order.
ORDER
1. Chamber Summons No.737 of 2018 is allowed.
2. Delay of 127 days for filing reply to the Summons for Judgment is
condoned and defendant is permitted to file on record the reply.
3. No order as to costs.
