Heard both the sides.
Plaintiff has filed the lease/license plan of the year 1977. In the
said plan there is specific mentioned about the enclosure of the
balcony. The letter of Estate Dept dated 30.04.2019 do show that
the lease plan of Estate dept. is at par with the plan of building
proposal dept. However, the designated officer nearly discarded
the lease plan and did not give sufficient reason thereof. Hence,
defendant corporation is directed to consider the documents
produce by plaintiff and then pass fresh speaking order. Till then
and in case of adverse order two weeks thereafter defendant
corporation shall not taken any coercive action in respect of the
suit premises. In view of this suit and draft NM are disposed
of. They be registered for statistical purpose. Proceeding is
closed.
