1) The Notice of motion is filed by plaintiff to condone
the delay to file written statement and the suit be stayed. The
plaintiff is not appearing in the notice of motion nor there is
service of the notice to the defendant. On perusal of affidavit of
Smt. Poonam Jaisinghani para no.4 states that her advocate was
unable to proceed due to illness of the plaintiff in the suit to
examine the second witness. Therefore, to recall order dated
12/03/2018. The plaintiff is not proceeding with the notice of
motion. It seems that the plaintiff is not interested to proceed.
Hence, pass following order:
