Order below Notice of Motion
Plaintiff filed NM and suit against defendant. Plaintiff is
claiming temporary injunction so that his structure should
not be demolished or removed without following provisions
of law.
I have heard Ld.Adv of plaintiff and Ld. Adv of defendant.
The officer of defendant corporation is present. She made
statement that defendant shall follow due procedure of
law. Hence statement of BMC officer is hereby recorded.
Adv of plaintiff submitted that in view of statement made
by BMC officer suit and NM may be disposed.
After considering submissions of both the parties I proceed
to pass following order in the interest of justice
ORDER
1.Defendant is hereby directed to follow due procedure of
law.
2.If defendant issues notice against plaintiff then necessary
legal time be given to plaintiff to reply the notice and to
approach the court if required.
3.In view of above order NM and suit stands disposed off.
NM and suit be registered for statistical purpose.
