By way of present chamber summons plaintiff seeks to alter the address of the defendant.
It appears that plaintiff tried to serve the defendants on the address mentioned in the plaint. However, the service could not be completed. Therefore, plaintiff seeks to add school\''s address in the title of the plaint.
Considering th nature of prayer, I find it just and proper to allow the amendment and thereby permit incorporation of new address in the title clause of the plaint as per the schedule appended to the chamber summons. Hence, the order-

Perused chamber summons and affidavit in support thereof. It is submitted by the plaintiff that defendants are served on new address. However, it needs to be amended in the title clause. On perusing record, it appears that plaintiff has served writ of summons on defendant on new address, as mentioned in the schedule annexed to the affidavit of chamber summons as per Exh-5. Perused application and record. Heard Ld. counsel for plaintiff. Plaintiff has filed evidence on affidavit and compilation of documents. The documents at Sr. No.10 filed vide list Exh-8 were not marked as exhibits as same are photocopies. Therefore, plaintiff has filed this application to allow to lead secondary evidence to prove the said documents at SR. no.10. The said documents are photocopies of lorry receipts dated 01.07.2016, 12.07.2016 and 18.07.2016 of Chintamani Travels. It is the contention of plaintiff that said receipts are not traceable in the record of plaintiff company. Further, said copies are made from the mechanical process from original lorry receipts. Therefore, accuracy of xerox is ensured. The said contention of plaintiff is supported by affidavit. Hence, I am of view that it is necessary to allow plaintiff to lead secondary evidence in respect of documents filed at Sr. No.10 vide list Exh-8.
