The Decree Holder has filed Execution Application against Judgment Debtors and respondent Jeevraj Vakatawarmal and sought execution of decree against the respondent in terms of prayer clauses mentioned in Column No.J of Execution Application.
2. The respondent Jeevraj Vakatawarmal has tendered Notice of Motion No.2118 of 2022 raising objections to the Execution Application and for discharging him as party from execution proceeding. Whereas the Decree Holder prayed for issuing order of attachment under Order-XXI Rule 54 of the C.P.C. in terms of prayer clause (c) of the Execution Application.

The Notice of Motion 2214/25 is filed by the Judgment Debtor to direct the plaintiff's applicant to give true and correct disclosure on oath by filing an affidavit giving all particulars and details as to what property and how much money is recovered either from Defendant No. 3 or its retired/existing and or continued partners from time to time on the basis of consent terms dated 07.11.2012 and the decree dated 27.11.2012. It is further prayed that depending on the hearing and final disposal of this notice of motion, the decree holder i.e. the plaintiff may be ordered and directed to comply with prayer a of this notice of motion. The respondent has filed a detailed Affidavit in support of the notice of motion and contended that the plaintiff has recovered the huge amount either from the partnership firm M/s P.R. Enterprises being the defendant no. 3 or its retired existing and/or continued partners from time to time. Therefore, it is contended that it is necessary to direct the plaintiff to make full disclosure on affidavit about the amount received, and what properties he has received either from defendant no. 3 or its retired existing and or continued partners from time to time.
Advocate for plaintiff has strongly opposed the application and contended that all the details are disclosed in the execution application and that may be treated as a reply.
Heard both the sides and I have gone through the execution petition. In the execution petition, All the details with respect to the execution application filed and the amount recovered is mentioned. In addition to that, a note is filed to show that which execution application the plaintiff has filed, dispose of and the amount recovered. Taking into consideration this aspect, this Court is of the opinion that if any amount is not recoverable from the present execution petition filed, it is for the judgment debtor to show it Accordingly, this notice of motion be tagged with the CS pending before the court and will be decided along with the CS.
