F.R.S.R. following order on N/M No. 1618/20 is passed -
Order -
1. The Notice of Motion no.1618 of 2020 is partly allowed.
2. Mr. S. N. Redij, Deputy Registrar, City Civil and Sessions Court, Mumbai is appointed as Court Receiver in respect of the Room No.11, Obhan Niwas, N. S. Road, Mulund (W), Mumbai-400 080 with all the powers under Order 40 Rule 1 of the Code of Civil Procedure, including the power to take possession thereof.
3. The Defendants no.2, 3, 9, 10, 11, 13 and 14-A and B are temporarily restrained from demanding any sum on account of rent, municipal taxes, repair charges, maintenance, water, etc., from the tenants of the plaintiff in respect of the property bearing C.T.S. No.930 Obhan Niwas, N. S. Road, Mulund (West), Mumbai-400 080 till final disposal of the suit.
4. The Defendants no. 2, 3, 9, 10, 11, 13 and 14-A and B are temporarily restrained from entering into the suit property as described in Exhibit A to the plaint, i.e. C.T.S. No.930 Obhan Niwas, N. S. Road, Mulund (W), Mumbai-400 080 till final disposal of the suit.
5. In absence of details of amounts prayer clause (d) is rejected.
6. Costs in cause.
In view of grant of NM No. 1618/20, the NM No. 3367/17 (with similar facts and prayers) is also allowed in terms of prayer clause (b) and (c) till final disposal of the suit.
