1) The Chamber Summons is filed by the defendant to
condone the delay of 66 days to file reply in Summons for

Judgment. The Chamber Summons is supported by affidavit of
Nakul Ashok Jain who stated on oath that due to the illness of his
father and his father in law, he could not meet his advocate to file
reply. Hence, prayed to allow the Chamber Summons.
2) The reply is filed by advocate for plaintiff in the
Chamber Summons that subject to cost the Chamber Summons be
allowed.
3) Heard the advocate Shri. Kothari for plaintiff and
Advocate Shri. C.D. Mishra for defendant. Perused the Chamber
Summons alongwith the documents annexed to the Chamber
Summons to show that the father and father in law of defendant
were taking treatment in the hospital. The plaintiff has no
objection to condone the delay to file reply to Summons for
Judgment on cost. Hence, pass the following order:
ORDER
1. Chamber Summons No.718/18 is allowed.
2. The delay of 66 days caused to file reply to
Summons for Judgment is condoned on payment
of cost of Rs.3,000/ to the plaintiff.
3. On payment of cost, reply be taken on record.
