Perused affidavit in support of this N/M. Considering reason stated for causing delay to file reply to
N/M of the Plaintiff and in order to decide N/M of the Plaintiff on merits by giving opportunity to
Defendant no. 2 to file reply. It is just and proper in the interest of justice to allow this N/M. Hence,
I procceed to pass the following order. Order 1. Notice of Motion no 1761/19 is made absolute in
terms of prayer clause (a) and (b) 2. Defendant no. 2 is directed to file reply to N/M no. 840/19. 3.
Accordingly Notice of Motion no. 1761/19 stands disposed of. In view of order passed N/M no.
1761/19, reply of Defendant no. 2 to N/M no. 840/19 be taken on record. Reply to N/M no. 840/19
tendered by Defendant no. 2. t.o.r. Matter is adjd. to 23.09.2019 for N/M hearing. LO at 3.20p.m.
From department, it is pointed out there is no compliance of all objection, there is no leave obtained
from the court u/s 80(2) of CPC. Hence suit is not registered.
