Heard, Adv. Naik. According to him the proposed def. no. 7 is occupying the suit premises which was tenanted to def. no. 4 Kasif. The suit is for mandatory injunction and taking action in respect of unauthorized construction allegedly carried out by def. no. 4 to the suit premises. Therefore the def. no. 7 being occupant of the said premises, his presence is necessary.
The Ch/ s is made absolute in terms of prayer clause (b). Plaintiff to comply with the order within two weeks. There upon issue writ of summons to def. no. 7 r/o 24.07.2018.
