CHS NO.931/19 This Chamber Summons is taken out by Plaintiff for deleting name of deceased
Defendant no.1 and for bringing his LRs on record. Plaintiff has filed affidavit in support of
Chamber Summons. Copy of burial certificate of Defendant no.1 Peter Dominic Fernandes is filed
on record showing his date of burial as 01/04/2019. This Chamber Summons was taken out
immediately on 22/04/2019 and Defendants have not replied Chamber Summons. Considering the
fact that Plaintiff is intending to name of deceased Defendant no.1 and Plaintiff is intending to carry
out amendment in plaint for bringing LRs of Defendant no.1 on record, I find that Chamber
Summons is necessary to be made absolute. Hence, I proceed to pass following order - ORDER 1.
Chamber Summons no.931 of 2019 is made absolute in terms of prayer clause (a) and (b). 2.
Plaintiffs are directed to carry out proposed amendment in the plaint within stipulated time provided
by law. 3. Plaintiffs are further directed to serve the copies of amended plaint upon proposed
Defendants and other Defendants and to file typed copy of amended plaint for the record of the
court. Case is adjourned to 16/08/2019 for compliance.
