Today on behalf of the plff. pursis is filed, it is t.o.r and marked at Exh.38. In view of the Exh.38 it is intimated that the cause of action in the present suit brought about one Deft.no.3 to 6 no longer exists. The plff.has withdrawn the suit against defts.no.3 to 6. The suit therefore stands disposed of as withdrawn against defts.no.3 to 6 in consonance with Exh.38.
In view of the statement made by the concerned officer of MCGM Mr.Kevalchand Sontakke, Jr.Engineer on 30.01.2018,that the suit road pertains to the private road belonging to the plff.and the said road is not taken over under section 291 of MMC Act.
