holding for S. K. Srivastav and Company and Adv. Rawade
for BMC on Ch/s No. 698/2018. Smt. Surekha Parwadi
AO School is also present. By this Ch/s the plaintiffs wish
to bring on record the notice dtd. 23.03.2018 issued by the
defendant in the name of plaintiff no. 2 and make certain
averments about the legality and vires of the said notice.
The plaintiffs also wish to bring on record certain
photographs showing the condition of construction of suit
premises and further to make additional prayer. The Ld.
Adv. For plaintiff makes submissions in consonance with
the contentions raised in the Ch/s. On the other hand Ld.
Adv. For defendant submits that the Ch/s has been taken out
only with a view to protract the hearing of NM. According
to her no separate ground has been made out to grant the
Ch/s.
Business : Considering the submissions, it appears that the plaintiffs
wish to bring on record the events, documents subsequent
to the filing of the suit. In the circumstances in order to hear
the matter on merits, the Ch/s is made absolute in terms of
prayer clause (a) and (b). Considering the urgency in the
matter the plaintiff is directed to comply with the order on
or before the 20.04.2018. The matter is fixed for arguments
on NM to 21.04.2018 Earlier order if any to continue till the
next date. An ordinary copy of this order duly authenticated
by the Sheristedar of this Court be supplied to both the
parties.
