This notice of motion is taken out by defendant No.2 and 3 for setting aside order dated 20.2.2020 directing the suit to proceed exparte against defendant No.2 an 3 and for permitting them to file the written statement.  It is the contention of these defendants that there were chances of settlement.  The defendants were under pretext that the plaintiff will withdraw the suit and therefore, they did not approach to their advocate for filing W/S. It is their further contention that the defendants are residing at Nashik, there is delay of 92 days. From the perusal of the record, it appears that the plaintiff and the defendants are close relatives.  All defendants have filed common written statement which is kept for order after decision of this motion.  Considering the reasons stated in the motion and also awarding chance to the present defendants to defend the suit on merit  I pass following order:
ORDER
1. N/M NO. 2208/2021 is allowed subject to costs of Rs.1000/-.
2. Order dated 20.02.2020 directing the suit to proceed exparte against def.No.2 and 3 is set aside. They are allowed to file written statement.
3. Costs shall be paid to the plaintiff.
4. N/M No.2208 of 2021 is disposed of accordingly.
