This Notice of Motion is taken out by defendant as there is
delay in filing the written statement on record.
2. Defendant submitted that they appeared in the matter on
10.04.2018 by filing Precipe. The suit had already exparte against them
on 09.02.2018. Hence, they are filed this notice of motion. It was
submitted that the documents relevant to the transaction were at the
factory and they could not find the documents in time and due to this
delay occurred.

3. Upon considering the hearing there does not appears to be
deliberate delay. Thus, opportunity is granted to defendant to file the
written statement on record in the interest of justice by imposing costs.
Accordingly, I pass the following order.
: ORDER :
1. Notice of Motion No.1514 of 2018 is made absolute in terms
of prayer clause (a) and (b).
2. Defendant is directed to pay the cost of Rs. 3,000/ to the
plaintiff on or before next date.
3. After payment of cost, written statement be taken on record.
