ORAL ORDER
Present draft notice of motion is taken out on behalf of
defendant No.1 making prayer to condone the delay in fling
his written statement and to take his written statement on
record.
2. Advocate for defendant no.1 submitted that copy of the
plaint and notice of motion alongwith afdavit were served
upon defendant no.1 on or about 18.12.2019 by hand. Then
defendant no.1 made contact with his advocate and prepare
the written statement on 21.01.2020. He tendered said
written statement in the Court on 22.01.2020 but this Court
refused to take the same on record without condonation of
delay application. Hence he fled the present draft notice of
motion.

3. Advocate for plaintif given no objection to allow notice
of motion fled on behalf of defendant no.1.
4. Suit is between the parties for declaration of shares.
Defendant no.1 is real brother of plaintif. Considering the
nature of suit, relations between the parties and no objection
given by advocate for the plaintif, notice of motion needs to
be allowed. In the result, following order.
ORDER
1. Draft notice of Motion No........... of 2020 is allowed and
made absolute in terms of prayer clause (a).
2. Accordingly, notice of motion is disposed of.
3. It be registered for statistical purpose.
