This court made absolute notice of motion in favour of landlord of suit premises. The same suit premises, the same notice is challenged by occupant (plaintiff) in the present suit. On the other hand it is submitted by BMC plaintiff had no locus standing to challenge notice by institution of present suit.
      From the record it is clear that, notice U/s. 351 dt. 03/08/2020 of MMC Act and speaking order dt. 24/02/2021 were challenged by landlord in L.C. Suit no. 699/2021, prior to this tenant/occupant challenged said notice and speaking order in the present suit. Protection is granted to the landlord against implementation of notice and speaking order. Hence, it is just and equitable in the eye of law to keep the present suit alongwith L.C. Suit no. 699/2021 for passing necessary order in NM no. 477/2021.
