Exh.3
Partner Smt. Aruna Mukesh Sawla of the plaintiff is present with
ld Adv Mr. Jaywant for the plaintiff.
Chairman Pandit Shende and Secretary Sachin Mayekar of deft
are present with ld. Adv Mr. S.B. Patankar for deft.
They filed consent terms at Exh.3.
The authority letter issued in favour of Smt. Aruna Sawla and
the copy of Resolution No.3 dt. 26.02.2021 authorizing Shri
Pandit Shende and Sachin Mayekar are produced with the
consent terms.
On enquiry, partner of the plaintiff and authorized
representatives of the defendant have admitted the content of
consent terms to be true, correct and admissible to them hence,
consent terms are read, recorded and accepted. In the result, suit
is disposed off as settled between the parties in view of the
consent terms Exh.3.
A consent decree be drawn up accordingly of which, consent
terms Exh.3 shall form part and parcel.
Court fees as per rules be refunded to the plff.
NM.560/2020 of the plaintiff is disposed off as the matter is
settled as above.
Draft Notice of Motion taken out by the defendant for delay
condonation is also disposed off as the suit is settled as above.
Said draft Notice of Motion be got registered for statistical
purposes.
Proceeding is thus closed.
