ORAL ORDER
The present application is filed by the Defendant No.3 for
delivery of interrogatories to the Plaintiff under Order XI Rule 4 of the
Civil Procedure Code.
2) After hearing both the sides as length and on perusal of the
interrogatories delivered to the Plaintiff by the Defendant No.3, I find

that, instead of adhering to the case management hearing, the
defendant No.3 has delivered these interrogatories to the Plaintiff at the
stage of trial and all the questions raised therein are in the nature of
cross-examination for instance, he has asked question about the
Distributorship Agreement, which could be asked in cross-examination.
He has mentioned interrogatories No.9 for asking the question,
“whether the plaintiff has any documentary evidence to show that the
defendant No. was in-charge and was also responsible for day-to-day
affairs and management and business of M/s. Panchanam Ratail
Products Pvt. Ltd. Similarly other questions are asked regarding the suit
invoices. All the said are more in the nature of cross-examination and
can only be answered by the Plaintiff at the trial of the suit. The issues
are already framed, moreover the evidence of the PW-01 is also filed on
11.06.2024 and 22.07.2024. Hence, no useful purpose will be served by
allowing the interrogatories. Hence, I proceed to pass the following
order:-
ORDER
1. Application Exh.15 is hereby rejected.
2. No order as to costs.
3. Application Exh.15 stands disposed off accordingly.
