None present for respondent.
Perused application and heard both the parties. The other
side has no objection for the transfer application.
It appears that Notice of Motion No.1743/2015 in Suit
No.640/2013 was heard at length by Shri M.T. Asim the Judge of
C.R.No.2. However, it seems that, meanwhile the said Notice of
Motion alongwith the Suit got transferred to C.R.No.9 and the
matter could not be decided.
Now both the parties want that since the Notice of Motion
was heard at length by Shri M.T. Asim, it is necessary that the
said Notice of Motion alongwith the suit be retransferred to his
Court so that he can deliver the order on Notice of Motion.
Since the Notice of Motion No.1743/2015 was heard on
merits by Ld. Judge presiding C.R.No.2, in the facts and
circumstances of the case it is necessary that the Notice of Motion
No.1743/2015 be decided by Ld. Judge only as he has already
heard it at length.
In view of above, I pass the following order.
O R D E R
Application is allowed.
Notice of Motion No.1743/2015 alongwith Suit
No.640/2013 stand transferred from C.R.No.9 to C.R.No.2
presided over by Shri M.T. Asim for disposal in accordance with
law.
Concerned Courts be informed accordingly.
