Advocate for defendant submits that the Notice of Motion has been taken out for framing preliminary issues under section 9A of CPC and as now the said provision is repealed, the NM can be disposed off. Therefore, Notice of Motion No. 1638 of 2019 is disposed off as withdrawn.
