The following Order is passed in Notice of Motion No. 396/2025:
ORDER
Today plaintiff and his Adv present before the Court. They
submitted that vide order dtd 18.02.2025 passed by Hon’ble Bombay
High Court in AFO No. 105 of 2025, they are withdrawing present
suit unconditionally as they have approach the appropriate authority.
Since the matter is not pursuaded by the plaintiff, I believe there
remains nothing to ponder over further.
In the backdrop, the plaintiff is not willing to proceed with
the present NM as no cause of action survives. Defendant raised no
objection to that effect. As plaintiff is not proceeding with the NM,
when ad-interim are already rejected, I believe there remains nothing
to ponder over. As NM is not proceeded, and not pressed, it stands
disposed of. NM bearing No. 396/2025 is disposed of finally in above
terms.
Order below Exhibit 7 -
Considering the reasons, as the plaintiff is not willing to
proceed with the matter, they are permitted to withdraw the suit
unconditionally. The suitable order follows below Exhibit 1.
Order Below Exhibit 1:
In view of the Order on the application (Exhibit 7), the suit
stands disposed of as withdrawn unconditionally by the plaintiff. All
the pending applications are, therefore, filed. The plaintiff to bear
costs of this suit. Bill of costs be drawn-up accordingly. Court fees be
refunded as per rules.
The Original documents, if any, filed on record be returned to
the respective parties, on their submitting its Certified Copies, if the
documents are exhibited, or Self-attested True Copies, if the
documents are not exhibited, along-with undertaking to furnish the
originals as and when required by the Court. The concerned
Department to do the needful. The proceeding is closed.
